1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and The Forge Hut, LLC ("we," "us," "our," or "The Forge Hut"), governing your access to and use of the Ebbi application and any related services, websites, and content (collectively, the "Service").

By downloading, installing, or using Ebbi, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use Ebbi.

If you are using Ebbi on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

Ebbi is intended for users who are 13 years of age or older. By using the Service, you represent that:

We do not knowingly permit children under 13 to create accounts or use the Service. If we discover that a user is under 13, we will take steps to remove any associated data and terminate access.

You also represent that your use of Ebbi does not violate any applicable laws or regulations in your country or jurisdiction.

3. Description of Service

Ebbi is a focus companion and productivity tool designed with ADHD-informed principles. It helps users plan tasks, build focus habits, and work with their brain's natural patterns, drawing on publicly available peer-reviewed neuroscience research.

Key characteristics of the Service:

We reserve the right to modify, update, or discontinue any aspect of the Service at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation of the Service.

4. Medical Disclaimer

Ebbi is a productivity and focus planning tool. It is not a medical device, medical service, clinical application, or mental health treatment.

Nothing in Ebbi, including any reference to ADHD, attention, focus, neuroscience, executive function, or any other health-related topic, constitutes medical advice, clinical guidance, a diagnosis, a treatment recommendation, or a substitute for professional medical care. Ebbi does not provide therapy, counseling, coaching, or any clinical service of any kind.

References to peer-reviewed research, neuroscience concepts, or ADHD-related strategies within Ebbi are included for educational and informational purposes only. The presence of such information does not imply that Ebbi is a treatment for ADHD or any other condition. Your use of Ebbi does not create a doctor-patient relationship, a therapist-client relationship, or any other professional relationship between you and The Forge Hut, LLC.

If you have been diagnosed with ADHD or any other medical or mental health condition, or if you believe you may have such a condition, please consult a licensed medical professional, psychiatrist, psychologist, or other qualified healthcare provider. Do not delay seeking professional advice because of something you read or experienced in Ebbi.

Ebbi is designed to be a helpful tool alongside professional support. Results vary. Ebbi does not guarantee any particular outcome in productivity, focus, symptom management, or quality of life.

If you are experiencing a medical or psychiatric emergency, call 911 (or your local emergency number) immediately. For mental health crisis support, call or text 988 (Suicide and Crisis Lifeline, US) or contact a crisis service in your country.

5. Subscriptions & Payments

5.1 Available Plans

Ebbi offers two subscription tiers: Monthly at $4.99 per month (recurring, cancel anytime) and Annual at $47.99 per year (recurring, discounted). All prices are in US Dollars and may vary by region due to local currency conversion and applicable taxes, as determined by Apple or Google. Current pricing is also displayed in the app at the time of purchase.

5.2 Free Trial

New subscribers may be eligible for a 14-day free trial of the monthly or annual plan. The trial is available to users who have not previously subscribed to Ebbi and who have not previously received a free trial for the same subscription group. The opt-in trial offered through the app starts without any payment method enrollment. If you choose a subscribe-at-onboarding option that includes a trial, your Apple ID or Google account is used for billing but no charge will occur during the trial.

At the end of the 14-day trial period, your subscription will automatically convert to the paid monthly or annual plan you selected and you will be charged the then-current subscription fee unless you cancel at least 24 hours before the end of the trial. The current price is displayed in the app at the time you start your trial and can be reviewed at any time in your Apple ID or Google account subscription settings. Apple and Google also display the trial end date in those settings.

5.3 Express Consent to Auto-Renewal (California AB 2863)

By subscribing, you give your express affirmative consent to the automatic-renewal terms described in this Section 5, as required by California Business and Professions Code § 17602 (as amended by AB 2863, effective July 1, 2025). The App Store receipt generated by Apple or Google at the time of your purchase serves as the record of your affirmative consent. We retain subscription records for at least three years, or one year after termination of your subscription, whichever is longer, consistent with California recordkeeping requirements.

5.4 Apple App Store Subscriptions (iOS & macOS)

If you subscribe through the Apple App Store, the following terms apply:

Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

To cancel an Apple subscription:

  1. Open the Settings app on your iPhone or iPad (or System Settings on Mac).
  2. Tap your Apple ID / name at the top.
  3. Tap Subscriptions.
  4. Find Ebbi in the list and tap it.
  5. Tap Cancel Subscription and confirm.

5.5 Google Play Subscriptions (Android)

If you subscribe through Google Play, the following terms apply:

Payment will be charged to your Google Play account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions in Google Play.

To cancel a Google Play subscription:

  1. Open the Google Play Store app on your Android device.
  2. Tap your profile icon in the top right corner.
  3. Tap Payments & subscriptions, then Subscriptions.
  4. Find Ebbi and tap it.
  5. Tap Cancel subscription and follow the prompts.

5.6 Refund Policy

All purchases are final. Because billing is handled entirely by Apple or Google, refund requests must be made directly through their respective processes:

We do not have the ability to issue refunds directly for purchases made through Apple or Google. Their refund policies govern all such requests.

5.7 Price Changes

We may change subscription prices from time to time. We will provide advance notice of any price changes before they take effect (see Section 5.3 for California-specific timing requirements). For auto-renewing subscriptions, Apple and Google will notify you of price changes per their respective policies, and you may cancel before the new price takes effect if you disagree with the change. Continued use after a price change constitutes acceptance of the new pricing.

5.8 Availability

Ebbi is offered worldwide through the Apple App Store, with the exception of the European Union, European Economic Area, United Kingdom, Switzerland, China, and Russia. Residents of those excluded jurisdictions may not be able to subscribe. Additional consumer-protection rights under the laws of your country of residence will apply where required by mandatory local law.

6. Intellectual Property

Ebbi and all of its contents, including but not limited to the application code, user interface design, graphics, logos, icons, copy, educational content, the "Ebbi" name, and all related trademarks and trade dress, are the exclusive property of The Forge Hut, LLC and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

Your purchase of a subscription grants you a limited, non-exclusive, non-transferable, revocable license to use Ebbi on your personal devices for personal, non-commercial purposes in accordance with these Terms. You do not acquire any ownership interest in Ebbi by purchasing a subscription.

Nothing in these Terms grants you rights to use The Forge Hut's or Ebbi's trademarks, logos, or branding without our prior written permission.

7. Your Content

All tasks, lists, notes, focus sessions, settings, and any other content you create within Ebbi ("Your Content") belongs entirely to you. You retain full ownership of Your Content.

Your Content is stored on your device. When you are signed in to iCloud, Your Content also syncs through Apple's iCloud service to your other Apple devices, where it is governed by Apple's privacy and storage practices. The Forge Hut does not collect, store, or have access to Your Content on its own infrastructure, and we cannot view, retrieve, recover, or transfer Your Content on your behalf.

By creating content in Ebbi, you do not grant The Forge Hut any license to Your Content. We may, in the future, introduce features (such as expanded sync, sharing, or new platforms) that change how Your Content is stored or transmitted. Any such change will be described in the Privacy Policy and you will be notified before it applies to you. You are solely responsible for maintaining backups of Your Content and for any loss of data resulting from device failure, accidental deletion, iCloud account changes, or other causes.

You agree not to use Ebbi in any of the following ways:

You agree to defend, indemnify, and hold harmless The Forge Hut, LLC and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

12. Arbitration & Class Action Waiver

12.1 Informal Resolution First

Before initiating formal arbitration, you agree to contact us at [email protected] and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally. Most concerns can be resolved this way, and we genuinely want to help.

12.2 Binding Arbitration

If a dispute cannot be resolved informally, you and The Forge Hut agree to resolve all claims, disputes, or controversies arising out of or relating to these Terms or the Service exclusively through final and binding individual arbitration, rather than in court, except as provided in Sections 12.4, 12.5, 12.6, and 12.7 below.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and, where applicable to coordinated or mass filings, under the AAA's Mass Arbitration Supplementary Rules (both available at adr.org). The arbitration will be conducted in English. You may choose to have the arbitration conducted by telephone, video conference, or based solely on written submissions. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The arbitrator has authority to award the same damages and relief as a court, including injunctive relief on an individual basis. However, the arbitrator has no authority to conduct class arbitration or a representative action. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. This delegation is a material part of the parties' agreement to arbitrate.

Consistent with the AAA Consumer Arbitration Rules, filing fees for consumer claimants are capped at the amount set by AAA's consumer fee schedule (currently $200 for individual consumer claims). The Forge Hut will pay the remaining AAA fees and the arbitrator's fees for individual consumer arbitrations, as required by the AAA Consumer Rules. Each party is responsible for its own attorneys' fees unless the arbitrator awards fees under applicable law.

12.3 Class Action Waiver

YOU AND THE FORGE HUT EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. All disputes must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding. If this class action waiver is found unenforceable, the entire arbitration clause shall be null and void.

12.4 Opt-Out Right

You have the right to opt out of binding arbitration and the class action waiver by sending written notice to [email protected] with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved in courts as set forth in Section 13 (Governing Law). Opting out does not affect any other provision of these Terms.

12.5 Small Claims Court Exception

Either party may bring an individual claim in small claims court in the county where you reside or in Shawnee County, Kansas, provided the claim qualifies under the small claims court's jurisdictional limits.

12.6 Quebec and Certain Canadian Provinces

If you are a consumer resident in the Province of Quebec, Canada, the binding arbitration clause and class action waiver in Sections 12.2 and 12.3 do not apply to the extent prohibited by article 11.1 of the Quebec Consumer Protection Act or other applicable Quebec consumer protection law. Residents of other Canadian provinces retain any additional rights granted by their local consumer protection statutes notwithstanding any contrary provision in these Terms.

12.7 Other Jurisdictions with Non-Waivable Consumer Rights

If you are a consumer resident in Australia, New Zealand, Japan, South Korea, Singapore, Brazil, Mexico, India, or any other country where local law grants non-waivable statutory consumer rights, nothing in Sections 12.2 or 12.3 limits those rights, including any rights to bring claims before local courts or consumer tribunals.

13. Governing Law

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict of law principles.

For disputes not subject to arbitration (including where the arbitration clause does not apply), you agree to the exclusive jurisdiction of the state and federal courts located in Shawnee County, Kansas, and you consent to personal jurisdiction in those courts.

For consumers resident in any jurisdiction with mandatory consumer-protection laws (including but not limited to Quebec, Australia, New Zealand, Japan, South Korea, Singapore, Brazil, Mexico, and India), those mandatory laws apply to the extent they provide greater protection than Kansas law.

14. Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect. The invalidity of one provision does not affect the validity of the rest of these Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy and End User License Agreement, constitute the entire agreement between you and The Forge Hut, LLC with respect to your use of Ebbi and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter herein.

No failure or delay by The Forge Hut in exercising any right, power, or remedy shall constitute a waiver of that right, power, or remedy. Any waiver must be in writing and signed by an authorized representative of The Forge Hut to be effective.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices. When we make changes, we will update the "Last updated" date at the top of this page.

For material changes (those that meaningfully affect your rights or obligations), we will provide at least 30 days' advance notice, either through the app, by email (if you are on our email list), or by posting a prominent notice on our website. Your continued use of Ebbi after the updated Terms take effect constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, your only remedy is to stop using Ebbi and, if applicable, cancel your subscription before the new Terms take effect.
